Agreement to Terms

By hiring CDM Concord Masonry for any masonry services, you agree to these terms of service. These terms apply to all estimates, contracts, and work performed by our company. Please read them carefully before moving forward with any project.

Estimates and Quotes

We provide free estimates for all masonry projects. Our estimates are based on the information you provide and our on-site inspection. Final pricing may change if we discover hidden damage, structural issues, or additional work needed once the project begins. We will notify you of any changes before proceeding with extra work.

Estimates are valid for 30 days from the date provided. Material costs and labor rates may change after this period. All estimates become formal contracts only when both parties sign a written agreement.

Payment Terms

Payment schedules vary by project size. For projects under $5,000, we require payment in full upon completion. For larger projects, we typically request a deposit before starting work, with progress payments based on project milestones. Final payment is due when the work is completed and you have inspected it.

We accept cash, checks, and major credit cards. Late payments may be subject to interest charges of 1.5% per month. If legal action becomes necessary to collect payment, you agree to pay our reasonable attorney fees and court costs.

Project Timeline

We provide estimated completion dates for all projects. These dates are our best professional estimate based on normal working conditions. Delays can happen due to weather, material availability, permit issues, or unexpected site conditions. We will keep you informed of any delays and work to get your project back on schedule as quickly as possible.

Permits and Approvals

You are responsible for obtaining any necessary permits unless we specifically agree in writing to handle permits for you. We will advise you on what permits your project needs, but final responsibility rests with the property owner. Work cannot begin until all required permits are in place.

Warranty

We guarantee our workmanship for one year from the date of completion. This warranty covers defects in our installation or construction methods. It does not cover damage from settling, earthquakes, freezing, accidents, or normal wear and tear.

Material warranties are provided by the manufacturers. We will help you file any warranty claims for defective materials, but we are not responsible for manufacturer defects beyond arranging replacements.

Changes to Work

If you want to make changes after we start your project, we will provide a written change order with the cost and timeline impact. No changes will be made without your written approval. Change orders may affect the overall completion date and final price.

Site Access and Safety

You agree to provide clear access to the work area. This includes removing vehicles, furniture, or other items that might block our work. You also agree to keep children and pets away from the work site for safety reasons. We are not responsible for damage to items left in the work area.

Cancellation Policy

If you cancel a project after we have started work, you agree to pay for all work completed, materials purchased, and a cancellation fee to cover our mobilization costs. If you cancel before work begins but after signing a contract, you may forfeit your deposit.

Liability Limitations

We carry full liability insurance and workers compensation insurance. Our liability is limited to the cost of repairing or replacing defective work. We are not liable for indirect damages, consequential damages, or damages beyond the original contract price.

Dispute Resolution

If any dispute arises, we agree to first attempt to resolve it through direct communication. If that fails, both parties agree to mediation before pursuing legal action. Any legal disputes will be handled in Contra Costa County, California courts.
